SALT LAKE CITY — A lawsuit challenging state lawmakers' lumping of more than a dozen bills — including ones that were defeated — into an omnibus education bill in 2008 questions how the Utah Legislature does business.

The Utah Supreme Court heard arguments in the case Wednesday.

"It was at the last minute, in the last two days, that they were bundled together," attorney Alan Smith told the court, which convened at the University of Utah law school. "That's a classic log rolling maneuver."

The state legislature of Arizona has passed a bill that vastly broadens telephone harassment laws and applies them to the Internet and other means of electronic communication.

The law, which is being pushed under the guise of an anti-bullying campaign, would mean that anything communicated or published online that was deemed to be “offensive” by the state, including editorials, illustrations, and even satire could be criminally punished.

For me the interesting part of the story is the ever-evolving “coed”. I put that in quotes because in the beginning she was described as a Georgetown law student. It was then revealed that prior to attending Georgetown she was an active women’s right advocate. In one of her first interviews she is quoted as talking about how she reviewed Georgetown’s insurance policy prior to committing to attend, and seeing that it didn’t cover contraceptive services, she decided to attend with the express purpose of battling this policy.

LITTLE ROCK, Ark. (AP) — Hold the mystery meat: Military mess halls soon will be serving more fruits, vegetables and low-fat dishes under the first program in 20 years to improve nutrition standards across the armed services.

First lady Michelle Obama and Pentagon officials announced the effort Thursday during a visit to Little Rock Air Force Base in Arkansas, where the military has been experimenting with ways to improve the quality and variety of foods served on base. The first lady toured a gleaming cafeteria line, then announced the program in a dining hall filled with service members whose plates were overflowing with salad greens, broccoli and whole grains.

Irondale, AL (EWTN) – EWTN Global Catholic Network filed a lawsuit February 9 in U.S. District Court in Birmingham, Alabama against the Department of Health & Human Services, HHS Secretary Kathleen Sebelius, and other government agencies seeking to stop the imposition of the contraception mandate as well as asking the court for a declaratory judgment that the mandate is unconstitutional. EWTN is the first Catholic organization to file suit since the final HHS rules were published by the Obama administration on January 20, 2012.

The United Nations says that the earth is in great danger and that the way you and I are living is the problem.  In a shocking new report entitled, "Resilient People, Resilient Planet: A Future Worth Choosing" the UN declares that the entire way that we currently approach economics needs to be changed.  Instead of focusing on things like "economic growth", the UN is encouraging nations all over the world to start basing measurements of economic success on the goal of achieving "sustainable development".  But there is a huge problem with that.  The UN says that what we are doing right now is "unsustainable" by definition, and the major industrialized nations of the western world are the biggest culprits.  According to the UN, since we are the ones that create the most carbon emissions and the most pollution, we are the ones that should make the biggest sacrifices.  In addition, since we have the most money, we should also be willing to finance the transition of the developing world to a "sustainable development" economy as well.  As you will see detailed in the rest of this article, the United Nations basically wants to crash the world economy in order to save the environment.  Considering the fact that the U.S. and Europe are in the midst of a horrible economic crisis and are already drowning in debt, this is something that we simply cannot afford.

Livingston County, NY – Judge Robert Wiggins dealt a major setback to New York Governor Cuomo and Mayor Bloomberg in the lawsuit brought by Liberty Counsel against the same-sex marriage law (“Act”). In response to the flagrant violations of the New York state constitutional and legal procedures, Liberty Counsel filed suit in the New York Supreme Court against the Act, which was signed into law on June 24, 2011, by Gov. Cuomo. The state asked the court to dismiss the case, but yesterday afternoon, Judge Wiggins sided with Liberty Counsel on the Open Meetings complaint, ruling that the case may proceed to trial. Liberty Counsel represents New Yorkers for Constitutional Freedoms and several other plaintiffs.

(Reuters) - The Obama administration plans to announce on Thursday it will explore a new route for a Canada-to-Texas oil pipeline, delaying a final approval beyond the 2012 U.S. election, sources briefed on the matter said.

The decision would be a victory for environmentalists, many of whom oppose the pipeline, and a setback for TransCanada Corp, whose $7 billion Keystone XL project is seen as the most important North American oil pipeline plan for decades.

Continuing a fiat governance style that is right out of the Obama playbook, Democratic and Working Families Party Governor Dannel Malloy issued two executive orders yesterday that will force daycare providers and home healthcare workers in Connecticut to join unions.

The orders, his ninth and tenth since taking office in January, will force the state’s 4,000 daycare providers to add over $1 million in dues to union coffers, and remove the right to secret ballot election for these workers by instituting a card check process.

Rick Snyder announced Wednesday that the state would begin tracking kids' body mass index through the Michigan Care Improvement Registry. Assembly Bill 889 (authored by Assemblyman Tom Ammiano, D-San Francisco, will require these protections for all “domestic employees,” including nannies, housekeepers and caregivers.

The bill has already passed the Assembly and is quickly moving through the Senate with blanket support from the Democrat members that control both houses of the Legislature – and without the support of a single Republican member. A few hours ago, the Food and Drug Administration declared it no longer needs credible evidence to seize food that may be contaminated. Ignoring the Fourth Amendment entirely, the FDA claims that based on mere suspicion that a food product has been contaminated or mislabeled, and that serious illness or death will result, it can hold the food for 30 days while it then looks for evidence. It claims this power under the Food Safety Modernization Act, which President Monsanto, I mean, Obama, signed in January.

The Senate plans to work through the weekend to ratify the New START Treaty and a trillion-dollar spending bill to keep the government running.

The upper chamber is expected to vote on final passage of the tax package shortly after noon Wednesday, which will clear the way for debate to begin on the nuclear arms treaty and the 1,924-page spending bill.  “We’ll see how things go with this treaty, but it’s clear — I have spoken on many occasions with the Republican leader — we’re going to be in session this Sunday,” Senate Majority Leader Harry Reid (D-Nev.) said Wednesday morning. “There is work to do.”

From the recently-passed Financial Regulatory Reform bill:  Per Nancy...
 
Section 342, subsection (f) states:  Each agency shall take affirmative steps to see diversity in the workforce of the agency at all levels of the agency in a manner consistent with applicable law.  Such steps shall include -- (1) recruiting at historically black colleges and universities, Hispanic-servicing institutions, women's colleges and colleges that typically serve majority minority populations.
 
According to Tom Donahue, President and CEO of the U.S. Chamber of Commerce, approximately 47 new agencies will be created by this bill.  That means that there will be at least 47 new "diversity czars."  Paraphrasing Mark Lloyd, the newly-minted diversity czar at the FCC, someone will have to step down so someone else may step up. 
 
Merit, it seems, has become nothing more than a footnote to a resume. 
 
According to Mark Calabria, Director of Financial Regulation Studies at the Cato Institute, "The Dodd bill would push the government into the business of dictating the terms at which consumers and businesses can contract.
 
According to Neil Cavuto the Dodd bill is a "two-thousand page Financial Regulatory Reform bill which creates new government agencies which not only write the rules but enforce the rules and have the power to seize corporations it deems aren't following those rules."
 
The federal bureaucracy has grown by 25% since the beginning of the year.  Government employment explodes while the private sector continues to contract.  Further, the legislative branch of government is being circumvented, since the new rules in the financial bill, health care bill, and cap and trade will be written by government-appointed regulatory officials -- not Congress, which is comprised of people who you voted into office for the purpose of representing your goals -- not the goals of the Federal Government. This should concern, if not alarm, you. 
 
One of the Constitutional principles which holds and balances our country is the doctrine of checks and balances:  The Executive Branch, the Legislative Branch and the Judicial Branch.  We see how Congress' power has been diminished (Sen. Russ Feingold, D-Wisc. presented a bill over a year ago protesting the appointment of so many czars, recognizing that his vote in Congress -- and that would mean your vote in a representative republic -- was being diminished.)  With the appointment of Sonia Sotomayor (for whom ethnicity trumps merit) and Elena Kagan (who refuses to deny that the federal govt. has the right to dictate what you eat -- It was a question meant to direct the response directly to the legitimacy of the Commerce clause of the Constitution, which is being used to mandate the purchase of health care by individuals.  Seeing the trap Kagan refused to answer the question.)
 
Both the legislative and judicial branches are being "reformed" by the executive branch, and power is being sucked up into the executive branch.   I'll raise the point again:  Steve Forbes' article last year:  "Is Chavez-style Communication Coming to America?"

Top Obama administration officials met Tuesday with utility executives in another sign that senior Democrats are pushing to salvage a limited climate change bill this year.

House Democrats have offered to exempt the National Rifle Association from a sweeping campaign-finance bill, removing a major obstacle in the push to roll back the Supreme Court’s Citizens United ruling.

 

The NRA had objected to some of the strict financial disclosure provisions that Democrats have proposed for corporations and politically active nonprofits and that had kept moderate, pro-gun Democrats from backing the legislation.

 

But if the NRA signs off on the deal, the bill could come to the House floor as early as this week. The NRA said it would not comment until specific legislative language is revealed.
