Lawmakers are working to block an unprecedented power grab by the Environmental Protection Agency to use the Clean Water Act (CWA) and control land alongside ditches, gullies and other ephemeral spots by claiming the sources are part of navigable waterways.
These temporary water sources are often created by rain or snowmelt, and would make it harder for private property owners to build in their own backyards, grow crops, raise livestock and conduct other activities on their own land, lawmakers say.

The Obama administration said Monday that it would appeal a federal judge’s ruling that the Environmental Protection Agency illegally vetoed a major coal mining project in West Virginia.
In a scathing decision in March, the United States District Court judge, Amy Berman Jackson, wrote that the E.P.A.’s unilateral decision in January 2011 to retroactively revoke the waste disposal permit for the Spruce No. 1 mine in Logan County, W.Va., overstepped the agency’s authority. Her ruling paved the way for the mountaintop removal mining project covering 2,278 acres to go forward.

If the Environmental Protection Agency has anything to say about it, “King Coal” is about to be dethroned and banished from the realm.
For the past three years, coal has been under almost constant attack, the latest being EPA’s proposed rule on greenhouse gas emissions from power plants. When all the rhetoric is stripped away, this rule would essentially end the construction of conventional coal-fired power plants in America, exposing the administration’s “all of the above” energy strategy as actually just “some of the above.”

Averting the worst consequences of human-induced climate change is a "great moral issue" on a par with slavery, according to the leading Nasa climate scientist Prof Jim Hansen.
He argues that storing up expensive and destructive consequences for society in future is an "injustice of one generation to others".
Hansen, who will next Tuesday be awarded the prestigious Edinburgh Medal for his contribution to science, will also in his acceptance speech call for a worldwide tax on all carbon emissions.

The U.S. government last year announced a $10 million award, dubbed the “L Prize,” for any manufacturer that could create a “green” but affordable light bulb.
Energy Secretary Steven Chu said the prize would spur industry to offer the costly bulbs, known as LEDs, at prices “affordable for American families.” There was also a “Buy America” component. Portions of the bulb would have to be made in the United States.

The United Nations says that the earth is in great danger and that the way you and I are living is the problem. In a shocking new report entitled, "Resilient People, Resilient Planet: A Future Worth Choosing" the UN declares that the entire way that we currently approach economics needs to be changed. Instead of focusing on things like "economic growth", the UN is encouraging nations all over the world to start basing measurements of economic success on the goal of achieving "sustainable development". But there is a huge problem with that. The UN says that what we are doing right now is "unsustainable" by definition, and the major industrialized nations of the western world are the biggest culprits. According to the UN, since we are the ones that create the most carbon emissions and the most pollution, we are the ones that should make the biggest sacrifices. In addition, since we have the most money, we should also be willing to finance the transition of the developing world to a "sustainable development" economy as well. As you will see detailed in the rest of this article, the United Nations basically wants to crash the world economy in order to save the environment. Considering the fact that the U.S. and Europe are in the midst of a horrible economic crisis and are already drowning in debt, this is something that we simply cannot afford.

The biofuels bust continues. The latest failure: Range Fuels.
Last week, the company defaulted on a government-guaranteed $80 million loan that it had used to build an ethanol plant in Georgia. AgSouth Farm Credit, the servicer of the loan, will begin a foreclosure sale on the plant in January. The foreclosure provides yet another indictment of the Obama administration’s energy policies.

NEW YORK (CNNMoney) -- The United States is awash in gasoline. So much so, in fact, that the country is exporting a record amount of it.
The country exported 430,000 more barrels of gasoline a day than it imported in September, according to the U.S. Energy Information Administration. That is about twice the amount at the start of the year, and experts and industry insiders say the trend is here to stay.

As of 2008, Newt Gingrich’s position on the science of global warming was essentially the same as Al Gore’s. FBI agents armed with search warrants descended Thursday morning on bankrupt solar company Solynrda.
The investigation comes after a request by the Department of Energy's inspector general, FBI spokesman Peter Lee told NBC Bay Area News.
Agents arrived at Solyndra at 7a.m. and were examining the factory. Solynrda has a skeleton crew of 100 workers on the scene, who are closing the factory down.
"It's been an interesting [two weeks]" says Solyndra spokesperson Dave Miller, referring to both the bankruptcy and the FBI raid. "I don't know what they're looking for...but I haven't seen them take anything."

Next January the Environmental Protection Agency (EPA) is set to issue new regulations on emissions from boilers used in facilities like oil refineries, paper mills, and shopping malls. The EPA claims their new regulations will only cost the economy $9.5 billion by 2013. But the American Chemistry Council says the cost will surpass $20 billion and kill 800,000 jobs. Who is right? We don’t know. But what we do know is that if you total up all of the new regulations already passed by the Obama administration last year, using their own cost estimates, fiscal 2010 saw the largest increase in regulatory burdens placed on the U.S. economy in the nation’s recorded regulatory history.

Canada provides the United States with tens of millions of barrels of oil that otherwise would have come from Saudi Arabia, the misogynistic sheik-ocracy that most of the 9/11 hijackers called home. But leftists don’t care about that. They’ve recently convinced huge American companies like Bed, Bath & Beyond to boycott Canadian oil. Activists say the oil sands devastate the landscape, cause cancer, cheat aboriginals out of land and revenues, and are a major source of toxic unicorn farts CO2 emissions.
Too bad none of that is true. And you should care because getting your oil from a friendly neighbor instead of a dubious Middle Eastern “ally” or unstable African dictatorship is a matter of national security.

Specifically, she told the Today show: “I think it’s also important to note that our scientists have done an initial assessment and more than three-quarters of the oil is gone, the vast majority of the oil is gone.” Now it appears that Browner spoke too soon and, even worse, suppressed criticism of the Obama administration’s assessment of the spill.

During a 45-minute conference call with journalists from 40 major media outlets this morning, Jack Gerard shared some startling predictions about the future health of the nation’s oil and natural gas industry if the Obama Administration gets its way in adding more regulation and increasing taxes on offshore drilling in the Gulf of Mexico. A New Orleans federal judge lifted the six-month moratorium on deepwater drilling imposed by President Barack Obama following the largest oil spill in U.S. history. Drilling services shares jumped on the news.
Obama temporarily halted all drilling in waters deeper than 500 feet on May 27 to give a presidential commission time to study improvements in the safety of offshore operations. More than a dozen Louisiana offshore service and supply companies sued U.S. regulators to lift the ban. The U.S. said it will appeal the decision.

President Obama is planning to sneak through his job-killing, economy wrecking carbon tax by stealth according to the Washington Post, by passing a weakened bill and then adding in cap and trade provisions after the heat is off following the November elections.
Described as the “lame duck climate strategy,” Obama is planning to secure enough votes in the Senate to pass a weakened energy bill and then drag out the conference long enough to ensure the stronger provisions contained in the original House version are added “after lawmakers have faced voters in November, thereby cushioning the vote’s political impact.”

President Obama has a solution to the Gulf oil spill: $7-a-gallon gas.
That's a Harvard University study's estimate of the per-gallon price of the president's global-warming agenda. And Obama made clear this week that this agenda is a part of his plan for addressing the Gulf mess.
So what does global-warming legislation have to do with the oil spill?
Good question, because such measures wouldn't do a thing to clean up the oil or fix the problems that led to the leak.
The answer can be found in Obama Chief of Staff Rahm Emanuel's now-famous words, "You never want a serious crisis to go to waste -- and what I mean by that is it's an opportunity to do things that you think you could not do before."

After months of hard work, the Murkowski Resolution of Disapproval, will be up for a vote on June 10th. This is an important resolution that could stop a massive EPA power grab. FreedomWorks friend and ally Tom Borelli has a great update on this battle over at Townhall.com.
If Congress does not step in to block EPA, the agency can use the Clean Air Act as a blunt tool to widen its jurisdiction into almost every nook and cranny in our lives. Every sector of our economy -- transportation, power generation and manufacturing -- would be subjected to EPA’s bureaucratic reach.
Indeed, every business that uses fossil fuels to heat, cool, light or run its manufacturing operations or emits greenhouse gases would need permits from EPA to function.

Despite the most creative rhetoric this side of ObamaCare, voters have figured out that "cap and trade" involves artificial carbon rationing and vast new energy taxes. So the main goal of John Kerry and Joe Lieberman has been attempting to disguise these truths in the climate bill they released to much fanfare last week.
The bill was nine months in gestation once it became clear that the version the House passed last summer—which one of five Democrats opposed—was doomed in the Senate. Yet no one should mistake Kerry-Lieberman for a new approach.
